These Terms of Service ("Terms") govern your access to and use of samuellynne.com (the "Site") and the products, services, and communications offered by Samuel Lynne Galleries ("Samuel Lynne Galleries," "we," "our," or "us"). By accessing the Site, contacting the gallery, or opting in to receive communications from us, you agree to these Terms. If you do not agree, please do not use the Site or our services.
1. Use of the Site
You may use the Site for lawful, personal, and non-commercial purposes. You agree not to use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use of the Site. You agree not to attempt to gain unauthorized access to any portion of the Site, any account, or any system or network connected to the Site.
2. Artwork Information and Inquiries
Information about artists, artworks, exhibitions, and events presented on the Site is provided for informational purposes. Availability, pricing, dimensions, and condition are subject to change and confirmation by the gallery. The display of an artwork on the Site does not constitute an offer of sale, and inquiries are confirmed in writing by gallery staff.
3. Sales, Payments, and Shipping
Sales of artwork are made under a separate written invoice or sales agreement issued by the gallery, which governs the specific terms of that transaction including payment, title transfer, shipping, insurance, returns, and warranties. In the event of a conflict between these Terms and a signed sales agreement, the signed sales agreement controls for that transaction.
4. SMS Program Terms
Samuel Lynne Galleries operates an SMS program for clients and prospective clients who have opted in to receive text messages from the gallery. By providing your mobile number and ticking the SMS consent checkbox on a Samuel Lynne Galleries website form or walk-in form, you agree to the following terms.
Age restriction. You must be 18 years of age or older to use this SMS service.
Program description
• Program name: Samuel Lynne Galleries SMS.
• Sender: Samuel Lynne Galleries.
• Categories of messages: promotional messages including exhibition invitations, private viewing invitations, and new artwork release notifications, and transactional messages including appointment confirmations and reminders, artwork hold notifications, sales and shipping confirmations, and follow-up communication on active inquiries.
• Frequency: message frequency varies, typically up to six messages per month.
• Cost: message and data rates may apply. Samuel Lynne Galleries does not charge for the messages we send, but your mobile carrier may charge you according to your plan.
Opt-in
You are added to the SMS program only after providing your mobile number and ticking an
unchecked SMS consent checkbox on a Samuel Lynne Galleries website form or walk-in form. The checkbox includes the disclosures listed above and links to this Terms of Service and our Privacy Policy.
Opt-out
You can cancel the SMS program at any time by replying STOP to any message you receive. After you reply STOP, you will receive a single confirmation message and will not receive any further marketing or promotional SMS messages from Samuel Lynne Galleries. If you want to rejoin the program, sign up again using one of the opt-in methods above.

Carriers
Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and other major U.S. carriers. Carriers are not liable for delayed or undelivered messages.
Mobile information sharing
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. See Section 3 of our Privacy Policy for full details on how mobile information is handled.
5. Email Communications
If you provide your email address, you may receive emails from the gallery related to your inquiries, transactions, and (where you have opted in) marketing communications. You can unsubscribe from marketing emails at any time using the link in any email or by contacting us.
6. Intellectual Property
All content on the Site, including text, images, photographs, video, logos, marks, and the selection and arrangement of content, is owned by Samuel Lynne Galleries, the represented artists, or their respective licensors, and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without prior written permission from Samuel Lynne Galleries and, where applicable, the relevant artist.
7. Third-Party Links
The Site may contain links to third-party websites and services. We do not control these websites and are not responsible for their content, privacy practices, or terms. Your use of any third-party website is at your own risk and subject to the terms and policies of that website.
8. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. SAMUEL LYNNE GALLERIES DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SAMUEL LYNNE GALLERIES, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100.00). NOTHING IN THIS SECTION LIMITS LIABILITY THAT CANNOT LAWFULLY BE LIMITED.
10. Indemnification
You agree to defend, indemnify, and hold harmless Samuel Lynne Galleries, its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney’s fees) arising out of your use of the Site or our services, your violation of these Terms, or your violation of any rights of a third party.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas, and you consent to personal jurisdiction in those courts.
12. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent version. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
